How is the legal ceiling on a rent increase worked out?
15 October 2026 · 3 min read

When a lease is renewed in Türkiye, the rent increase has a ceiling. Under article 344 of the Turkish Code of Obligations, the increase for the new rental year may not exceed the change in the Consumer Price Index (TÜFE) by twelve-month averages over the previous rental year.
Which month's rate applies?
The figure of the month before the renewal month. TÜİK announces it at the start of each month. For a lease renewed in October 2026, for example, the September 2026 figure applies: 31.49%.
Is there a difference between homes and shops?
The temporary 25% cap on residential rents ended on 1 July 2024. Today the same rule applies to homes and commercial premises: the ceiling is the twelve-month average CPI.
Worth knowing
- If the contract sets a lower rate, that rate applies.
- The ceiling cannot be exceeded even if both sides agree.
- In leases older than five years, the rent may be set anew on equitable grounds.
